Emergency Relief
While courts prefer to adjudicate disputes with the well-considered
input of all concerned parties, after notice and a full hearing,
from time to time a legitimate emergency may require immediate court
action to prevent an irreparable injury. In such a case, the
court will entertain an application to enter an immediate emergency
order, without waiting for a written response to the emergency request
or setting a hearing days or weeks away. If a party learns
of an action, taken or about to be taken, which could be prevented
or remediated by a court order, preventing further harm and injury,
an emergency court filing should seriously be considered, and a competent
professional retained for that purpose as soon as practicable. In
some cases, hours or even minutes of delay can make the difference
between having a reasonable remedial option available or tragedy.
